Acceptance of Contract Terms

By accessing this web site and/or purchasing products from MariTool, you agree that you have read, understood and agree to be bound by all of the provisions set forth herein and below (collectively, the "Terms and Conditions"), all of which constitute an agreement between you and MariTool Inc. The unenforceability of any one of the Terms and Conditions shall not affect the enforceability of any of the other Terms and Conditions. The terms and conditions on any quotation, order acknowledgment, invoice or other form you receive from MariTool Inc. are incorporated into these Terms and Conditions by reference. These Terms and Conditions constitute the exclusive agreement between you and MariTool Inc., except as otherwise agreed in writing signed by us. Our failure to assert a right or insist upon compliance with any term or condition shall not constitute a waiver of that right or excuse any subsequent noncompliance. MariTool reserves the right to change these terms and conditions by posting a revision on this website.

Limitation of Liability

Under no circumstances shall MariTool Inc. be liable in contract, warranty, tort or otherwise for any special, exemplary, incidental or consequential damages that result from your purchase of any products from MariTool Inc. or any use of or the inability to use any content or products from MariTool Inc. In no event shall our liablity exceed the purchase price of the products you purchase from MariTool Inc. It is the users responsibility to inspect all products to determine if they are per specification required by you the end user.

Limitation of Functional Lifespan

It is understood by you the end user that cutting tools, retention knobs, tool holders, collets and inspection equipment have limited functional lifespans. It is your responsibility (the user) to determine the products proper functional lifespan and to put out of service and rebuild or dispose of properly. In no way shall MariTool Inc. be liable for damage to equipment, personnel or death for products used past its functional lifespan. In no way shall MariTool Inc. be liable for machinery down time, property damage, product damage, inventory damage or any other charges incurred to you the user for products used past its functional lifespan.

Cutting tools

By its nature cutting tools are dangerous and can be unpredictable. Cutting tools can break and shatter with great force. While cutting tools are used they can release chips, swarf, dust, sparks, fire and gases. It is the users responsibility to determine proper and safe protection from said cutting tool. Eye protection, machine guarding, ventilation equipment, fire protection and other misc safeguards must always be used effectively and must be maintained and tested. In no way shall MariTool Inc. be liable for any costs, machine down time, injuries, or deaths resulting from a cutting tools breakage or emissions.

Tool holders

All tool holders have a limited lifespan and require maintenance. Proper cleaning and oiling is important. Tool holder inspection should be a part of your setup routine. During inspection all surfaces should be checked for dents, scratches, cracks, rust, wear or burrs. Any of these imperfections may damage your machine and or create an unsafe condition. Heat shrink tool holders may be very hot during tool changes and great care must be taken while the tool holder is hot to avoid fire and injury. If uncertain of a tool holder condition we recommend you contact MariTool before using the tool in your machine.

Retention Knobs

Retention knobs (also called pull studs) are stressed components used to clamp the tool holder to its machine tool counterpart. It is the users responsibility to confirm that the retention knob (pull stud) purchased from MariTool Inc. is the correct shape, size and specification recommended by the machine tool builder. MariTool Inc. has no way of knowing your particular machine's spindle options, tool changer layout and drawbar pressure. In no way shall MariTool Inc. be liable for any costs, machine down time, injuries or deaths resulting from a retention knob breaking or improperly holding a tool holder in the machine tool.

MariTool Inc. may recommend by phone or email a retention knob part number if you are unsure of which to purchase. Our database of machine tools and corresponding retention knobs are derived from customer feedback, details from machine tool dealers, websites, technical publications and other sources. Although MariTool Inc. does its best to determine accuracy, our database is not always accurate with its recommendations. Even when a retention knob is recommended by MariTool Inc. it is still your (the user) responsibility to confirm that the retention knob (pull stud) purchased from MariTool Inc. is the correct shape, size and specification recommended by the machine tool builder. In no way shall MariTool Inc. be liable for any costs, machine down time, injuries or deaths resulting from a retention knob breaking or improperly holding a tool holder in the machine as a result of MariTool Inc. giving an incorrect recommendation or part number.

Retention knobs have a limited functional lifespan. In this industry most machine tool builders and retention knob manufacturers recommend replacing them every year. Using a retention knob past its functional lifespan may result in catastrophic failure and tool holder ejection. It is always the users responsibility to keep track and have in place a maintenance schedule to inspect retention knobs for tightness, wear and cracking. In no way shall MariTool Inc. be liable for any costs, machine down time, injuries or deaths resulting from a retention knob breaking or improperly holding a tool holder in the machine tool.

Technical Advice

MariTool Inc. may offer by phone or email technical advice. These recommendations (technical advice) are merely opinions from either past experiences or from trusted sources such as books or cutting literature. These recommendations are given as a courtesy and are given without charge. Due to the incredible amount of variables in your (the user) facility these recommendations may not be ideal or applicable. It is still your (the user) responsibility to confirm that using recommendations (technical advice) from MariTool are safe and within the limitations of your machine and setup. All such recommendations (technical advice) are given and accepted at your (the users) risk. In no way shall MariTool Inc. be liable for any costs, machine down time, injuries or deaths resulting from any incorrect recommendations.

CAD Files and PDF Prints

On many of our products we provide CAD files and/or PDF prints. These are provided as a convenient way of reviewing details and dimensions of our products. Although MariTool does its best to make sure these dimensions, specs, and features on these files and prints are accurate, errors may result. It is customers' sole responsibility to verify any dimensions or specs that are critical to his or her machine function or operation. We shall not be held responsible for any damages that may occur other than the price of the product itself.

JURISDICTION AND CHOICE OF LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois applicable to contracts made and to be performed in Illinois, without giving effect to conflict of law principles, and applicable federal law. Any personal information submitted will be subject to these laws, not those of any jurisdiction outside of the United States. You irrevocably consent to the exclusive jurisdiction of the courts located in Illinois in connection with any action arising out of or related to these Terms and Conditions or this web site. Notwithstanding the foregoing, proceedings to enforce the result of any such adjudication may be brought in any applicable forum.

General Warranty

MariTool Inc. warranties it's products to be free from defects in materials and workmanship for a period of 60 days from the date of original purchase. MariTool Inc. agrees to repair, or at our discretion, replace tooling supplied by MariTool Inc. which proves to be defective in materials or workmanship. This warranty is limited to defects arising from normal usages and does not cover any malfunctions or failures resulting from misuse, abuse, neglect, alteration, modification or repairs by other manufacturers. Any item repaired or replaced under warranty will only be covered for the remainder of the original item's warranty. A replacement item does not reset the warranty coverage date.

Returns and Refunds

A Return Authorization is required prior to sending your order back to MariTool.

To request a Return Authorization please contact MariTool customer service at 888-352-7773 x-3 and have your order number or account information available. All returns are accepted within 7 days of delivery with a Return Authorization. Returned items must be new, in original packaging and show no signs of wear, damage, abuse or alteration. Failure to meet these conditions may cause your request for return credit to be denied. We will gladly refund you the entire purchase price of your items less shipping and 10% restocking fee. Some items are not stocked by MariTool and are drop shipped directly from the manufacturer. Because of this, some items may have higher restocking fees depending on other vendor policies beyond our control. Please contact us if you have questions regarding this policy. Some items such as Pull Studs or any custom tooling are not returnable. Any item that is not allowed for return will be listed with that disclaimer.

Order discrepancies must be reported within 2 business days after receipt of order.

All refunds will be given in the original payment form (Credit Card, PayPal, Check etc.)

Shipping

Same day shipping Orders placed online with UPS selected as the shipper prior to 4pm central time Monday - Friday (excluding holidays) will ship same day. From time to time, due to conditions beyond our control, your order may not ship same day even when placed prior to our 4pm cutoff time. MariTool has the right to delay your shipment and upgrade your shipping method to meet your originally expected delivery date at no charge to you the customer.

Due to early carrier pick up USPS orders may require 1 additional business day for shipping.

Damaged Deliveries

If your package is damaged during transit please do not refuse the delivery. Instead, be sure to inform the delivery agent that the package appears to be damaged and a claim may be need to filed.

If any items are found to be damaged please contact our sales department for instruction on how to proceed.

USPS and UPS Signature Required

All UPS orders are by default shipped with signature required. This is for your protection as well as ours. At your request and acceptance of liability MariTool can request a package to be left without signature. MariTool cannot be held liable for any damage or loss if a package is left without signature.

All USPS orders over $100 will require a signature. This unfortunately is not an option, but required by USPS. MariTool cannot be held liable if a signature cannot be retrieved and your package delivery is delayed.

Drop Ship Items, Domestic Orders

In the event your order contains items that drop ship direct from the manufacturer MariTool will ship all items stocked in our facility while the other items are shipped from their manufacturer. There will not be any additional fees for shipping unless expedited shipping service is requested.

Drop Ship Items, International Orders

In the event you order contains items that drop ship direct from the manufacturer and your delivery address is located outside the United States your items will first be sent to MariTool Inc. for verification and inspection. Once verified your order will ship complete from MariTool with no additional shipping fees applied.

International Credit Card Payments and Refunds

If paying by credit card with a foreign currency the card issuing bank may charge a currency conversion fee. MariTool is in no way responsible for any conversion cost, rate or fees applied by the card issuing bank.

When returning or canceling items please be aware that upon issuance of credit the card issuing bank may charge a currency conversion fee. After these fees are applied the refund total may be less than the original payment. MariTool is in no way responsible for these fees charged by the card issuing bank.

Please reference the card issuing bank’s terms and conditions regarding conversion fees and currency rate fluctuations.

Delivery Refusals

If delivery is rejected or other refusal to accept delivery is made after an order has been shipped by MariTool, all fees including, but not limited to shipping, return shipping, restocking, duties, taxes, etc. will be the responsibility of the customer. A refund will not be given until all items are returned to MariTool and inspected. The above stated fees will be deducted from your refund.

Back Orders

Domestic Orders Domestic orders containing out of stock items will be shipped in multiple shipments. All in stock items will be shipped immediately while back ordered items will be shipped as they become available at no additional charge.

International Orders International orders containing out of stock items will be held until all items are available due to shipping, duty, brokerage and import tax fees.

Average lead time for a back ordered item is 2-3 weeks, however some manufactured tooling may require 6-8 weeks or more. Prior to ordering any item that is on back order you should inquire on expected delivery. While we do our best to provide accurate lead times, sometimes due to conditions beyond our control those lead times may be increased without notice.

All Orders By placing your order you are committing to a sale with MariTool and reserving those purchased items. Even when items are not available (out of stock) you will be charged in full for that product reservation. You have the right to cancel your order reservation at any time prior to shipping for a full refund.

Back Orders are fulfilled on a first come first serve basis.

Late Delivery, Lost Delivery

In the unlikely event that the delivery carrier you choose does not deliver your order on time or loses your order, MariTool will file a claim on your behalf, but cannot be held accountable for that loss. All orders are shipped with insurance for this reason and all carriers accept full liability for these orders.

The claims process for both UPS and USPS may be up to, but not limited to 30 days after opening an investigation. In most cases packages are located and delivered as quickly as possible. Refunds for late deliveries cannot be given with the exception of guaranteed UPS Expedited Services. Those refunds are at the discretion of UPS.

Orders that cannot be located after 30 days will be refunded by the carrier you requested and upon receiving that refund MariTool will prepare and fulfill a new order shipment to replace your original order or provide a full refund in the insured amount.

Order Accuracy

Order discrepancies must be reported within 2 business days after receipt of order.

Website Accuracy

We try to be accurate while listing our items on our website however, from time to time our product listings may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. MariTool Inc. reserves the right to correct any errors, inaccuracies or omissions and to change or update product information without prior notice (including after you have submitted your order).
